The Supreme Court of the Republic of Mordovia has ordered the Federal Penitentiary Service of the Russian Federation to re-examine the request of prisoner Ramazan Gadzhiev, in which he asks to be transferred to a colony closer to home. The corresponding decision came into force on August 8 of this year, according to the website of the Civil Assistance Committee.
The prisoner, a native of Dagestan, applied to the Federal Penitentiary Service of Russia and the Federal Penitentiary Service of the Republic of Mordovia with a request for transfer in August 2023. He wanted to change the place of further serving his sentence to a correctional facility in Dagestan or a neighboring region in order to maintain ties with close relatives who cannot afford to visit him in Mordovia.
However, the Federal Penitentiary Service of Russia refused to transfer him, explaining that he was allegedly in danger in Dagestan. However, Gadzhiev considers the refusal unfounded. According to him, there is no threat, since he has not served a sentence in a colony in Dagestan and does not know anyone there. At the same time, the prisoner complained of systematic torture in the Mordovian colony.
The court of first instance agreed with the decision of the FSIN of Russia, but Gadzhiev also appealed the refusal to the Supreme Court of the Republic of Mordovia, which agreed with his arguments and ordered the FSIN of Russia to consider his request again.
According to the lawyer who visited Gadzhiev, the prisoner complains about the infringement of his religious rights. He asks for a full inspection of IK-1 due to the cruel treatment of prisoners and violations of their conditions of detention.
