The prosecutor's office of the Kurchaloevsky district opened a criminal case No. 39051 on the fact of the abduction (Article 126 of the Criminal Code of the Russian Federation) of the residents of the village of Tsotsin-Yurt Shakhbievs: Ezir-Ali, born in 1974, Abzu, born in 1977, and Said-Magomed , born in 1978 The brothers were taken away at dawn on September 4, 2000. The Russian military, who arrived in at least four cars, lifted all the people in the house out of bed and took them out into the yard. For demanding an explanation of the reason for the rough treatment of the family, they hit the butt of a machine gun, and then forcibly drove the mother of these people into the room. Their father was also beaten - blood came out of his mouth. The military took the Shakhbievs away, not even allowing them to get dressed, in only their underwear. They also stole a Model 6 Zhiguli car belonging to the family and all the money in the house.

The fourth son, who at first actively helped in the search for the brothers, having become convinced of the inability and unwillingness of the authorities to restore justice that had been violated in relation to the family, left home. In early 2001, a message came to Tsotsin-Yurt that he had died and was buried in one of the cemeteries in the regional center of Shatoi. Mother went there, but did not find a grave, or anything that would confirm his death. However, she had no doubts about it. She often repeated: “For the one who died, I am calm. I would like to get some news about the three who were taken away.

On October 12, 2001, that is, two months after the initiation, the criminal case on the fact of the abduction of Ezir-Ali, Abzu and Said-Magomed Shakhbiyev was suspended due to the alleged impossibility of identifying the persons involved (Article 195 of the Criminal Code of the RSFSR).
